Summary
Gold-silver mining projects in Romania, such as those in Roșia Montană, Certej, and Rovina, face significant legal vulnerabilities that stem from early-stage deficiencies in licensing, urban planning, environmental assessment, heritage protection, and institutional coordination. These cumulative legal vulnerabilities progressively amplify over time, leading to administrative litigation and undermining the legality, predictability, and sustainability of mining projects. The research highlights structural continuities and recurring dysfunctions in the management of mining concessions, proposing an integrated ex ante verification model to assess legal compatibility holistically. This approach aims to reduce litigation and enhance legal certainty for future investments.
